Crickets...
« on: August 21, 2017, 03:21:10 AM »
I find it worrisome that hundreds participated in the last conference call but nobody is posting here about the issues we are all facing.
The only thing I have seen from broadcasters is on a Facebook group.
Most of it is very negative.
While I respect and understand the viewpoints presented there I just want to throw something out there:
If we don't find a way to stand together, we will not gain anything and risk losing it all.
None of us are heer for a quick buck or to rip-off anybody.
We are here to do things the right way.

This does not mean we have to agree with or even accept what is going on, it just means that us little-people need to stick together.
None of us impactd by the CRB ruling were expecting to get rich, but we are being treated like leeches and criminals for trying to obey the rules.
This is not how things are supposed to work.
While I understand the concerns of people who decided to pay ASCAP, please understand that those of who have decided to wait until the evidence is in are taking a risk on your behalf.
I am a musician and feel very strongly about artists getting paid what they deserve, but I also know that we deserve to be treated fairly by all parties.
Many of us PAY for the 'privilige' of doing what record companies and the PROs used to do: Support artists and promote them and their rights-and without getting one thin-dime for our efforts.
I'm not asking anyone to risk getting crushed by penalties, I am asking for all of you to come together to advance our passion and make the best use of technology to make things better for everyone involved.
YES, I would like SL and Stardome to do better at communication.
When they promise us updates, give us updates, even if they are just, "sorry, we can't tell you more right now.." updates.
YES, a more clear explaination of SL indenmnifiying us needs to happen.
And YES, we need to see some sort of roadmap to a resolution of this. But don't just give-up and waste all of the time you have already invested in your passion-it is also the passion of many others as well.
We can makes this work, we just need to try.
Thanks.

This is a specific issue between StreamLicensing and ASCAP (and the other Pro's), so there is not much we can do except wait to see if they come to an agreement of some kind.  If this were a legislative matter, I would say yes, we all need to band together and try to make an impact on the folks in Congress.  But this is a legal matter, so it's a little different.  There are some folks who have decided to jump ship completely (leave StreamLicensing).  For me personally, I felt it was inappropriate for SL to have stopped paying ASCAP completely, and I was worried about my personal liability, so I did sign with ASCAP.  But I am still with StreamLicensing and will stay with them for now hoping that they are able to work something out.  So right now, there really is not much to say or do, but just wait it out.

I think more people would be willing to post their thoughts and concerns here on this forum if it wasn't completely accessible to the public.  I'll guarantee you ASCAP is viewing everything being posted here.  How do you think they knew about the WKTF deal so quickly?  All you have to do is type "StreamLicensing Forum" into Google and you can see it all without even signing in.  This forum should be closed to the public and viewable to paying customers only, but it's not.  I'm hesitant to say too much here because of that.

I'll Chime in again...Stardome/Streamlicensing is doing their job guys...representing your licensing needs (that includes doing exactly what they are doing right now with their lawyers(on your behalf)... so you don't have to. I've seen very little fluctuation in the amount of stations streaming in the Directory,  which goes to the point that most of us are letting our Licensing Company do their job.  8) Cudo's to the rest of you determined Streaming Broadcasters! Nicely stated Drunken...."While I understand the concerns of people who decided to pay ASCAP, please understand that those of who have decided to wait until the evidence is in are taking a risk on your behalf".

I will reiterate this: It is illegal in almost any state to fail to refund overpayment.
SL has repeatedly stated they are willing to compensate us...ASCAP has said nothing of the sort...and rememeber you have audio tape of them saying all of this.
Once again, not trying to be critical of your concerns, just trying to stop the baby getting thrown out with the bathwater.

I wish SL success in getting back the overpayment. But I have nothing but criticism for the ill-conceived tactic of withholding payment from ASCAP. Paying our fees to keep us legally broadcasting has always been a separate issue from recovery of the overpayment - and SL should have foreseen that ASCAP would terminate SL's (and our) licenses - especially if it's true that payment was withheld for EIGHT months.

I like SL and I want to support them, but they are letting us down. It's time to end this and stop the bleeding. Fix it already. We should not have to risk broadcasting without proper licenses.

I agree.  The Forums should not be open to the public.

Elvise, you must work for ASCAP....lol just kidding but you seem to be constantly holding the moral high ground for ASCAP. I've been in The Broadcasting Business from the ground up since 1976 both TV and Radio and now Streaming...
to your points:

1. The Data error was a carry over from the previous owner..they did their job and found the error. (which we will benefit from in the future)
2. They addressed the error with all the Entities they have agreements with(thier job) and ASCAP was the only one with a problem.
3. At that point they used the advice of thier Counsel which I'm sure represent far more expertise than any of us have on the subject on the best way to proceed forward(thier job). That plan has been expressed to us repeatedly....again doing what I would expect from them. Thier job.

Based on my 40 years of experience I'm behind the way they are handling it....I think it's a well thought out plan...and I really like how they are looking to decrease the stacked odds against Streamers by Terrestrial Broadcasting influence since the beginning.

Disputes like this go on all the time ...whether it's financial, technical etc...
We hire entities (like Streamlicensing or Eng. firms,  consultants) to handle our affairs in those areas we've chosen them. Then let them do their job.

If you don't like the job they are doing you replace them or do the work yourself.

To The Grand;"We should not have to risk broadcasting without proper licenses." you don't ,pay ASCAP Directly if you feel you aren't covered.
Your fee's are currently being payed...the money is in an account that is solely for that purpose. They can't touch that money .....ASCAP knows that...and the court knows this wasn't an effort at non-payment should it go to court...IMHO

...now I'm going to use this controversy to get some free coverage for a station with the local news... about how they as a business are dealing with it! ..and what the latest promotion is:-)

Happy Broadcasting!

More hilarity from SL:

My apologies but I tried sending this yesterday and we had a SMTP issue.

I received this update from the higher ups in Orlando yesterday:
“Long term, we are moving forward to prevent this type of harassment that has occurred, working directly with Congress and powerful consumer interest groups.
We are moving forward in gaining an understanding regarding ASCAP to assure that you are fully protected and licensed. More details to come.
Also, more exciting developments that include an ownership plan that allows us, by strength in numbers, to work more efficiently and effectively with all the different music license agencies.”

Corporate has also assigned us a liason, Caleb Phillips, to help assist with customer questions and care. We will be getting a direct line for him to publish today or tomorrow. I believe he has already spoken to a couple of customers and they have said good things about him. Us support folks welcome the assistance and I'm certain you will too.

Warmest Regards,

Wes

At this point, the ONLY good news from SL would be an announcement that they've reached agreement with ASCAP and are, once again, paying them our royalties.

All these other announcements are simply tip-toeing around the issue.

Get it done, StreamLicensing, and stop giving us the runaround.

[Edit:  And, here's one more thing:  My stations have stopped playing on Nobex's apps (both StreamLicensing and iO2 Media) on the IOS platform.  After several weeks of e-mails back and forth and waiting on any word from them, they informed me this morning that MOST of the Streamlicensing stations aren't playing on their apps.  You might want to check yours.  Someone has dropped the ball on this one, too.]

Guys,

Copying and pasting every email that SL sends us here is like forwarding them directly to ASCAP.  We all got the email, so there is no reason to republish it here on the forum.  Until this forum is secured only for paying SL customers, I would be cautious to what is posted here.  They are reading everything posted here.  Think about it. ::)

Who cares at this point?

(However, you can delete your posts as long as you're logged into the board.  I deleted many of my angrier and angrier posts the other day.  LOL)

Pvradio could take that one down very easily.
